Construction Board of Appeals

The Ocean County Construction Board of Appeals was established by the Board of County Commissioners pursuant to the Uniform Construction/ Fire Code, State of New Jersey.

In order to have an appeal scheduled, the following information must be in the hands of the secretary prior to the statutory deadline: Applications must be received by the Board Secretary within 15 days after receipt of written notice of the enforcing agency concerning the Uniform Construction Code and 15 days for the Uniform Fire Code. Imminent Hazards within 24 hours. A completed application (be certain to provide contact information: address, phone number, email); a copy of the Notice of Violations/Orders to Correct; a check (non-refundable) in the amount of $100 which represents the filing fee, payable to: Ocean County Construction Board of Appeals.

Who can appeal?

The Appellant can be either the building home owner or an agent of same. If you are a corporation, however, you must be represented by Counsel.

In accordance with N.J.A.C. 5:23-2.35 or N.J.A.C. 5:70-2.19, the following is a partial list of notices that can be Appealed: Denial of an application for a permit; Failure of the municipality to act on an application for a construction permit; Failure of the municipality to act on an application for a Certificate of Occupancy; Denial of a variance; Assessment of penalties; Issuance of a Notice of Violation, Issuance of an Imminent Hazard; Stop Work Order, Notice of Unsafe Structure; Fire Lane Obstruction; etc.

The Board typically meets on the Second and Fourth Thursday of the month at 3:00 pm. in the Commissioners Meeting Room 119, 101 Hooper Avenue, Toms River, NJ

All hearings are subject to the provisions of Chapter 231, P.L. 1975, known as the "Open Public Meetings Act"; are quasi-judicial and recorded via electronic devices for future transcripts. Both the Appellant and the Municipality are entitled to one postponement each and this must be received within 48 hours prior to the scheduled assigned date. Withdrawals must be received with 72 hours prior to the meeting of the Board. Failure to appear will automatically result in a dismissal.
